Terms & Conditions
These terms and conditions govern the provision of chimney repair services (“Services”) by BMT Group (“Provider”) to you (“Customer”). By engaging our Services, you agree to be bound by these terms and conditions.
1. Scope of Work:
- Provider shall perform the chimney repair services as described in the agreed-upon estimate or work order.
- Any additional services requested by the Customer shall be subject to additional charges and may require a separate agreement.
2. Payment Terms:
- Customer agrees to pay the agreed-upon price for the Services as outlined in the estimate or work order.
- Payment is due upon completion of the Services unless otherwise specified.
- Provider reserves the right to charge interest on overdue payments at a rate of [X]% per month.
3. Cancellation Policy:
- Customer must provide at least 5 hours/days’ notice to cancel or reschedule an appointment.
- Failure to provide adequate notice may result in a cancellation fee.
4. Warranty/Guarantee:
- Provider warrants that the repair work will be performed with due care and in a workmanlike manner.
- Warranty period: 3 months/years from the date of completion.
- This warranty does not cover damages caused by misuse, neglect, or acts of nature.
5. Liability:
- Provider shall not be liable for any damages arising from the Customer’s failure to maintain the chimney properly after the repair work is completed.
- Customer agrees to indemnify and hold Provider harmless from any claims arising from the Customer’s breach of these terms and conditions.
6. Permits and Regulations:
- Customer is responsible for obtaining any necessary permits and ensuring compliance with local regulations related to the repair work.
7. Access and Cooperation:
- Customer agrees to provide access to the chimney and any necessary utilities required to perform the Services.
- Customer shall cooperate with Provider to facilitate the timely completion of the repair work.
8. Dispute Resolution:
- Any disputes arising from these terms and conditions shall be resolved through arbitration in accordance with the laws of [Jurisdiction].
9. Completion Timeframe:
- Provider shall make reasonable efforts to complete the repair work within the agreed-upon timeframe.
- Delays caused by factors beyond Provider’s control may result in an extension of the completion timeframe.
10. Cleanup and Debris Removal:
- Provider shall clean up the work area and remove any debris generated during the repair process.
11. Insurance:
- Provider maintains liability insurance coverage and shall provide proof of insurance upon request.
- Customer agrees to notify Provider of any damages or injuries that occur during the repair work.
12. Additional Costs:
- Customer acknowledges that additional costs may arise due to unforeseen complications or changes to the scope of work requested by the Customer.
These terms and conditions constitute the entire agreement between Provider and Customer regarding the chimney repair services and supersede any prior agreements or understandings, whether written or oral. No modification or amendment to these terms and conditions shall be valid unless in writing and signed by both parties.
